Where did I go right?

So, here I was writing off topic about love and how its crazy and how it makes one vulnerable and if you're not lucky enough, you'll find yourself miserable as well. Seriously, what is the right thing to do? Is there ever a safe way to go? complicated is an understatement. I can imagine how hard it is for someone who hates me for thinking that I stole someone from (that person). Now I am miserable. He writes all about it in his blog. I am not a fancy writer, but I get it. Well let me tell you something, I feel for you too. You can't force someone to grow up.

Where did I go right? At first this hilary duff song didn't make any sense but then I figured what it meant to me. I was just reading the entire lyrics and, yeah, now I understand. Extremely appropriate. I also learned about the logical consequence of catch 22, first heard about it in the show LA ink. It means, you are in a situation where you dont want to be involved but you feel like you cant do anything about it because youre already in it. I am happy, but if there are some people involved and both of you just cant seem to make ends meet, would this love ever go somewhere? anywhere. I dread for the time that youd call it off but I wanted to be positive about it, cognitive, as you would say. I made a couple of turns along the road as an attempt to get back on where I first started. But at some point, I no longer knew who was driving. It could only be a matter of time before the road gets bumpy. I hate it when that happens.

Enough

I dont even know where to start. I'd like to think that 5 or 6 years from now, i look back at this moment and just laugh about how I got tangled up into this web of lies and fragments of truth that shouldn't have been there because its very presence just makes it all hard to turn things around. I never knew "love" could be so painful and stupid sometimes. Some people might say, been there done that. Well, I say, I want to skip the tough parts and just get back on track. I am not a bad person, I had no intention of making someone miserable to my advantage, its like what he said, being a third party, is bullshit!-heartless and pointless. I guess I'm never gonna be good enough for anyone. People are always looking for something more, well, I don't have more, I can only give myself. When you give all of yourself, and that other person still wants something more, what is there left for you? Which is why I felt like my entire body just got flushed down to the drain my heart went down with it. I have no objections, Let life take its course.

NO more non sense

All those recitation wont be getting me anywhere, I need to pass the midterms and the finals to get through 1st semester. It is possible to cover the pointers for the exam but I am extremely nervous, and I am bad in planning my schedule in studying all law subjects.

Political law is still kind of a blur, I am having trouble picking up some of the major points in the book and the discussion although concrete is still a handful. Its funny that its like decoding a secret code and that the author of the consti book was a friend of shakespeare. Sigh! I just hope ill be able to pull through with this.

Think like any justice would?

It was a surprisingly interactive day for me today. Nothing much to say on Civil code, we were on article 36 psychological incapacitation as a ground for legal separation or annulment of marriage. I get the idea but I have yet to read the cases to really substantiate on the matter and the issues.

I was so pumped up again on criminal law today as we digest and discuss the circumstances affecing criminal liability (justifying circumstances) Our professor, fiscal Soriano was i think pleased in a non obvious way about how Ive justified the situation she gave on defense of a stranger. I know how important it is to be aware of certain requisites of these legal provisions because those were basically the baselines of how things should be dealt with. She said I would answer like any judge would-so i took that one as a compliment-I guess. That was a commendation and it meant a lot because that would only mean that I am finally understanding what I am rreading. Not to brag but the situations given were a no brainer, and a nothing like a good common sense would answer the questions.

i am hoping that I could keep it up in all my subjects.

cases and articles

Surprisingly, I am starting to get the hang of reading my law books. It gets a little frustrating at times, but they are tolerable. I sure do hope my patience will improve after indulging myself into honing my reading skill. Speaking of reading, I took the liberty of downloading case files from the class yahoo group page for our constitutional 1 assignment, and boy, were those cases lengthy. I read about the Guingona vs. Carague case, it was about questioning the unconstitutionality of a certain general appropriations act provision, and how there was a political question that was proper for the congress and senate to address. Whether a certain sum be appropriated for national debt services or that an appropriation should only be alloted for the principal fees and other bank charges excluding the debt services. So far, that was what i understood.

Next up, was the Luna vs Court of Appeals case. This case is somewhat similar to the Daoang case or any child custody case for that matter. Clearly this case had that Renvoi/referring back principle going on, because it was tossed up from the lower court then elevated to the higher court, then eventually the SC would refer it back to the lower court ordering the latter to issue a writ of execution. Now this is where it gets really interesting. The child in question vented out on a private hearing when asked by the appointed psychologist about whether she likes to stay with her biological parents, wherein, the child desisted and told the doctor that her real parents are hurting her and pretending that they love here only because they want her[child] on their side. She insisted further that she would kill herself if she will be in custody with her biological parents. The judge addressed this issue like any mother or parent would have. The custody went to the guardian/grandparents. The SC initially contested that the lower court should have pushed through executing the order, but due to the child's statement it was a valid supervening cause sufficient to amending the ruling,I think it is also worthy of noting that the state may have acted upon the doctrine of parens patriae.

adrenaline rush, is it?

Okay, last saturday, we had a mini, sort of informal debate for the legal prof/intro to law subject about why the bar examinations be abolished. I was in the affirmative side so even if I was rooting for the opposition , i had to make a stand. And so I did. I feared though that I might have overdone it, I just didn't know why I was so pumped and it was almost like I was looking forward for the opposition to take us down and me firing back at them with even stronger rebuttals. I guess that was the whole point of it. I delivered, but the professor said we werent quite there yet. I dont think ill ever show off like that again. I dont want my classmates to think that I was a complete show off and an airhead.

Then came forensics, we had a quiz on adjectives transmuted into their noun forms. It caught me off guard. I wasn't confident that i could answer those, but i wasn't worried either. So when we checked the papers I was surprised of the things that I still dont know, or had known that I didn't remember. I figured, if these were the kind of questions in the midterms, im doomed. Its all good.

Statutory Construction and Political Law

I spent the entire day reading Chapter 5 of Constitutional Law 1 about the fundamental principles and state policies. I was able to get the idea of each topic but I struggled a little bit on the technical areas that is beyond the scope of Constitutional 1 first semester. We kicked off the discussion on the Preamble, I seriously thought Atty. Castro would call up someone to recite the entire preamble-he didn't. I memorized it, but i doubt if I can deliver completely without glancing at the book. I was Relieved that he went straight to explaining the significance of the preamble.
He then talked us through about the state as a DEMOCRATIC government that is tempered by its Republican attribute [Section 1, Article II]. As otherwise it is noteworthy that the sovereignty resides on the people, but the Philippines is not characterized as purely democratic that the people governs themselves. Atty. Castro simply means that our government serves the people as mere representations and for the renovation with respect to the promotion of public welfare and his common good.
Quoting abraham lincoln's famous phrase" the government of the people, by the people and for the people [shall not perish from the earth]." On this note, the people was obliged to invoke a positive act to RATIFY the constitution making it a SOCIAL CONTRACT which can be seen as the surrendering portion of sovereign power by entrusting its fate upon the important constitutional agencies [government; element of the state] that individually have their own functions independent with each other as distinguished with the BLENDING OF POWERS and the SEPARATION OF POWERS. Our state is a government of laws NOT of men.
There is of course this crucial process of electing the members of the Senate and Congress employing the RULE OF MAJORITY OR MERE PLURALITY.
Section 4 (The Defense of the State) gets me thinking how powerful the law is as it implements orders and the intent of each provision is strongly administered. As a sovereign nation it is the people's responsibility as well as the AFP to protect our state from external threats to national security. It was stated in the Political law book that the Section 4 provision is based upon the inherent right of every State to existence and self-preservation.

Of the Civil Code, Criminal Law (07/01/10)

I keep telling myself "this is good, this is good". I figured, until I realize how important this study [law] is, I will never push myself hard enough to even make it to second semester in law school.

I have to write down what i specifically remember during the discussion today in persons and family relations as well as in Criminal law.

Civil Code, I was a bit relieved that we did a run around with article 11 because I had to be substantially familiar (as how atty Castro would put it) with it. It was about the requirements in obtaining a marriage license. We did a quick intro on that up until article 25. Boy! Marriage is a lot of work from the point you are to bring it up to the local civil registrar to the other formalities like marriage certificate, license, Consents and circumstances affecting its validity. Remind me again of the exceptions on each legal provisions. One thing I noticed is, we have these legal provisions as baselines, but when it comes to the implications or application to a case/commentary, it can be really tricky figuring out if the case falls within the context of the provision or if it steers away to the exceptions. Assignment articles to read further is articles 26 up until 36.

Our Criminal Law discussion today was interesting, it matters a lot indeeed if the student studied in advance because, all the professor would do is to tackle some of the main highlights off the articles and discuss, substantiate it with a couple of good anecdotes and examples from the book and its all up to us students to read the cases and commentaries. The felony chapter was a lot of work, but the new assignments caught me off guard. the circumstances affecting criminal liability is SOMETHING. I mean the topics makes up almost half the bulk of the text book. i was able to take down notes, but I thought they were crap cuz i cant keep up with the professors pacing, and all there is on my notes were phrases that is almost undiscernable and incomplete.

by the way, I am hoping that my writing style would improve. I wanna write like a real lawyer. I have to drop my almost informal writing schtick and crossover to more definitive and intelligent writing style. I can only hope for the best.

Dura Lex Sed Lex

Remind me again why I took up law. To say that this [law] is not just any other course I can take for granted will be an understatement. More often than not, I will be spending so much time figuring out a good strategy to keep me interested in reading as much law books I can get my hands on, notwithstanding comprehension apart from speed reading. Let me take this oppurtunity to write down the [technical] skills a law student should/must have. A good english grammar skill in writing is tantamount especially when you start digesting court cases, make pleadings and the like. I thought I'd use some fancy words on it, but i would rather not take that risk of failing because the professor cant find cohesiveness and rather just a bunch of unrelated facts and opinions [which is not recommended].

For law students, the civil and criminal books would be the bible. This figure of speech is exactly what it is, "res ipsa loquitor", speaks for itself. I feel the slightest twinge and an air of desperation everytime the professors gives us a multitude of topics and related cases on citations to research and familiarize. They say, the human mind can be manipulated and that is an interesting fact indeed. Think about memorizing the [class a]legal provisions, statutes, law, presidential decrees and some governing laws. Memorizing all of these is immaterial, which is why I make it a point that I have something to memorize each day. All the facts on the books are conditio sine qua non to an effective understanding of the law and how it is applied.

I can do this, like what the texts say, "dura lex sed lex", the law may be hard but it is still the law. Freshman law is austere and it never failed to meet my expectations. I want to get the this up on my sleeve until im ready for the BAR examinations.

That's when I thought, "hey! serves him right". He was flat out smart in College and he deserved it. He got it all figured out and planned, until the perfect oppurtunity came to him just like that. I said,"damn, Im gonna be stuck in here for a while, thinking my friends all left and gone.

drafty

How do you know if you live in a remote area and the place they call city is not like a city? If you forgot about traffic and busy streets, not that I have anything agains't it, but if you live in Iriga City, you may just find it rather refreshing in so many sense. Walking the streets worrying about getting mugged is the last thing you would had in mind. Its fairly safe, sometimes, kind of unpredictable. Iriga is not your typical suburban place, a suburb would be an improvement, far better. The young iriganeous are majorly influenced by modern pop culture while the enot so new generation wants to keep iriga as it is. I dont blame them, The metro is just crack.

Heart

I love watching the Passion of the Christ by Mel Gibson. The cinematography was superb and it gives me the chills, there is something about the whole movie that makes you feel all sorts of emotion. It has all these sorts of elements, that is packed into one whole movie where at one point you'd feel kind of happy, some scenes were scary, some funny, most of the time as you watch it there's gonna be a tear jerker, it was absolutely brilliant. Props to Mel Gibson for having an amazing vision that materialize and that is the passion of the christ.

Affiliate Marketing for Dummies

If your anything like me who well, not hate, but just dont like working for anyone and if you enjoy the internet as much as I do. Then you and I have something in common. I would say, I wish I learned more about navigating the web and working with advertisers and publishers as a means of monetizing or just simply adding more value to what you do-blogging. My head is gonna crack learning about affiliate marketing and how to go around it to effectively use it as a devise for promoting an ad, program, directing a link (SEO) or whatever I could do possible to promote my site. I see a lot of potential of bridging my content among sometimes warped cyber pathways to be searched and for people to read, and If im lucky enough; to gain followers. All these just gets crammed up in my head and for one second I thought, its either im not doing it right or I just dont have any idea how to optimize the value of my site, or could be both. I continually search for convenient ways to optimize my site and get the the know-how on working with advertisers, affiliate marketing and Search Engine Optimization (SEO) in general, and placing ads. The list could go on and on and I do not mind learning everything possible for me to get on with the program. Hopefully, I could get a practical way of generating income on websites/blogs through an easy step by step material that has much to offer than just the basics like what a typical guide on affiliate marketing for dummies book could provide. (although that would work for me as well).

Entry 1

I have so much time and I couldn't think of anything else to do but write. I applied for an online writing community as a freelance web content writer and I have yet to hear from them when to get the assignments as they said, response is to be expected in less than a week, it's only been 2 days. I hate the feeling of so much anticipation, it is killing me. Its not just the assignments I am worried about, its everything. I am reminded of the feeling I had December of Last year, when I felt like things are looking good for me. I couldnt wait to grab new oppurtunities and finally experience a new high. Im no chinese, but I dont know why I am fond of reading anything about feng shui or horoscopes, its just so weird that i can relate to it really well. Well, its the year of the ferocious tiger and I was born with the same animal symbol, what I thought would be a good year for me, didn't quite start off well. Oppurtunities were all over the place, I picked em up, they just slipped right out of my hand. I was devastated. To make matters worse, my grandmother recently had a heart attack. Thankfully she managed to recover, but the damage is done, literally. Portions of her heart muscle died down due to deoxygenation of the heart tissue caused by inadequate blood flowing through her heart. It is just as worse than it sounds. She is recovering well, but her blood hemoglobins were lower than normal, so shes taking medications to remedy and address all these problems. We are just trying to prevent her from getting a second heart attack. So I pray really hard for her to fully recover and for God to relieve and spare her from another heart attack.

The silver lining...

Im gonna pretend that I do not feel bad about turning down an amazing job offer. Working directly for a US research company in my own home doing web discussions with the CEO and executives?, that sounds like music to me. My grandmother recently had a heart attack she had been hospitalized for a week and she is slowly recovering. She might need to submit herself for an angiogram to determine the extent of the damage on her heart muscle caused by the heart attack. I am hoping that it would be minimal and that it does not require any surgical intervention. Anyway, I had to turn down the job offer because I have to accompany my lola to manila for the angiogram. I tried making amends and weigh things down, but of course, family on top of anything.

On board

"Hope springs eternal", I love imagining success and what not experiencing them. As much as I hate doing nothing and being idle, being crammed up is something that makes me want to eat those words and backtrack. I got so many things going on and am surprised I even have the time to update my blog. But I guess I get some form of relief or gratification in writing. I will just see how I am to do this coming week, i hate to admit it, but I am really bad in working with intense schedules. My determination will be put to the test, I am talking about major responsibilites, juggling between work and family responsibility kind off gets me off guard. I do not want to upset or disaapoint my boss especially that I will be working with him miles away. It is both a good and a bad thing, working at home, because it just screams convenience in some sense, I have to become completely independent especially in terms of troubleshooting or on making decision. I do not want to be micromanaged. I dont think it will be wise to "test the waters" on jumping into this business venture as legalities are involved and it all boils down to being drawn to earning US dollars. What can I say? Its the next best thing to working in the US.

Life...

This week will surely be personal for most of us who are deeply spiritual. I watched the 14th lenten recollection that was aired on national television this afternoon and it was headed by Father Jerry Orbos. Usually, i get tired of watching the "sharers" doing, well, sharing their experiences and anecdotes that never seem to end. It was particularly different this time as I got hooked up with their stories and I could tell it was genuinely heartfelt. With a lot of them have gone through the toughest of times, you as the audience would find yourself indifferent from what they've experienced. Hoowww! I may find myself contemplating on a lot of things this coming week. I particularly liked what father jessie orbos said about the good news and bad news and I qoute " the bad news is, when you go home, nothing has changed, same faces, same problems. But the good news is, your views and perspective in life will change, and the best change in your life, would be you".
To say that Life has been difficult for me is an understatement. All people would feel the same way. Although rich people wouldn't dare admit, im pretty sure their lows are monumentally similar with ours. One sharer said that she no longer sees trials and mishaps as punishments for all the wrongs she's done but blessings. It bothers me that I know this for a fact and its extremely hard to believe if your clouded with negativity and hopelessness. God is out there, we all are living testaments of his existence. Let us open ourselves to him and be happy.

Topic: Law Necrotizer much?

At first i kind of shrugged off my parent's suggestion of going to law school because I am already a nurse and lawyering is not something I imagine myself doing in the next 5 years. Now, things have practically changed the way I feel about law, It was an epiphany, I was just really disappointed on the Philippine Government's effort to make a radical change in uplifting our nation after liquidating national assets for all the wrong reasons I say, is not something worth paying our taxes for. To set the record straight,Corruption has now become a chronic disease. Corruption is like diabetes. Both contemptuosly undesirable. Like diabetes, it can cause severe and fatal complications. Both fortunately manageable nevertheless,but still creeps its way to doing more damage and eventually we all fall in that big black hole and leaves us numb and hopeless. I realized, law has nothing to do with this, it is us, who more often than not, bend the justice system with a strong conviction that we can easily get away with it. What does integrity mean to all of us? What values are we trying to express and establish? What promise do we stand for? The list of questions could go on and on, and if you have our dignified political personages give you their take on it , you'll surely get the almost perfect response from them.

For our people to continually suffer and our economic crisis takes its inevitable toll, what held back the countless proposals and resolution promise our good politicians made and hoped to accomplish? Do we still have what it takes to be among the lucrative titans in the name of succesful nation alongside our asean counterparts? Or do we keep planting red flags on our sacred grounds that takes us back to where our sucessful luminaries (heroes) resent and put out.

In my new journey to understanding and experiencing the real and "RAW" essence of Law. I hope to discover that our nation will no longer be an uphill battle, capitalizing on the more positive light in which it is viewed, Respect and Dignity.

As long as we are here, hoping to change the world, we should choose to be educated, we should practice our rights, we should know and go by the law, we should materialize our dreams to paint a better picture of the world, It is a stressful undertaking and may seem a lot to ask, but it is possible to get our country into fighting shape.

Seriously?! you could make at least 4k USD a month from scratch and you dont even have to leave the luxary of your own home? That is some serious money by the way. Sounds too good to be true? Well, I have done some research on home based jobs and it turns out that the Philippines is not a virgin to web/online based businesses or outsourcing services that usually requires just your standard laptop and a fast internet connection. Some requires extra important accesories such as, a headset with a microphone and a webcam for a far more complex type of work. But the big bucks comes with an extra big responsibility. Technically you are on your own, true, it has its perks, but juggling between deadlines for multiple articles (if you are, lets say an online content editor or a contributing writer using SEO (Search Engine Optimization)) and other priorities could become a handful, especially if you have it only as a part-time job, so all the other responsibilites could be in jeopardy if you do not know how to manage your time well. In addition, we all know, that deadlines kill creativity and hamper productivity, so if you have a natural flair in writing about almost anything, and would want to become a home based content writer and is comfortable with beating the deadlines, take it as your epiphany, your niche, be a writer.

On a less extreme note, if you cant handle the deadlines and you have at least some knowledge on the internet. Affiliate marketing using Search Engine Optimization might be the best for you. Its all over the web, its in youtube, social networking sites, its everywhere. If you were lured by an ad you see on youtube and you clicked on it? and you were directed to some advertising website endorsing a product, that's when the money comes trickling in for an affiliate marketer. If you have a website, that's great too,(if you do have a website you probably know all about SEO already but blog works well too), you would use SEO to boost and generate traffic on your website, some even have real time sophisticated software for you to use in campaigning the products of your publishers and you could track the status of your online business as well, and just watch it(profits) increase incrementally.

If you have previous experience as a call centre agent, you could just be doing the same thing on your own home. With a good headset with mic and a VOIP/Skype account, you could be working as a call centre agent on a graveyard shift for offshore clients or an english tutor for koreans (very common) and the pay is not bad at all,some companies offer a $3 an hour for a 40 hours/week pay scheme, it varies.

Life is simpler with technology and complicated at the same time, imagine the paradox on that.

The key to success in whatever you plan to achieve is to stay optimistic. Doubting your capabalities can potentially curb your chances of getting the job you want. There is also a need to plan the steps you have to take, think in advance and anticipate everything from job hunting to owning the job interview and getting the job. It is easier said than done, but when you know the elements of handling these situations well, you'll be surprised where it can take you. I had an experience where I applied as a call centre associate for a US General Insurance MNC in Singapore,that after a successful phone interview, the hr lady had me report for a personal interview the next day for further screening. One thing to remember, ALWAYS make a good First Impression. I had my corporate suit to look the part (looking good will make you feel better-which will give you a confidence boost). I reported at the office 5 minutes before the appointment time, (another POINTER, dont ever show up 1 or 2 hours early, being early is just as bad as being late). I will get into more specific details on the do's and dont's in a Job Interview on a separate article. Anyways, the hr manager asked me the usual job interview questions, "educational background, achievements, work experience, goals, interests, why this company? what skills I have that could be an advantage in the industry (call centre)? my understanding of the position, my understanding of their products and services-these are but some of the things employers would ask in a job interview and I am sure a lot of you can relate to it but being knowledgeable about these could make or brake you. To establish yourself as a good candidate, you have to maintain that smart aura all througout the process, that being said, I was able to grapple her interest and in the end got the job with an exciting proposal, she upgraded the position to a junior research executive. Having only one year of call centre experience, that is a milestone. One weapon up on your sleeve, prior to your interview, look up the company's website, read through the "about the company", products and services, look into even the smallest of details. I told her that I have studied the company's services and she had me talk through what I knew, then she tried to be tricky by asking me, where their main office located, that was a no brainer! hehe. I answered with no hesitation. I could tell she was impressed, so when you sense it, you know you got it in the bag. So truth of the matter is, you are your own good luck charm, think big and positive. There could be some roadblocks along the way but again, when you plan ahead, things could run smoothly.
